treatlocal.co.uk is a provider of Covid-19 tests to the healthcare sector and the general public through its websites and collection locations throughout the UK. The range of Covid-19 tests includes PCR, antigen and antibody tests. Treatlocal is also a booking platform for health services offered by pharmacies and private clinics throughout the UK.

TERMS OF USE

The terms of use apply generally to all users that access the services of treatlocal.co.uk unless otherwise specified.

User account

To access certain services or features of treatlocal.co.uk, users might be required to create a user account. It is the sole responsibility of the user to ensure that they select a strong password and protect their login credentials. Any activity taking place under a particular user account is the responsibility of that user. The user is also responsible for reporting any suspicious activity that may harm treatlocal.co.uk or its customers or partners promptly. The user is also responsible for providing accurate information and maintaining the information up-to-date.

Our services are only available in the United Kingdom. Our website exists primarily to promote our services in the United Kingdom and also services provided by independent pharmacies and private clinics. To utilise our services, you must be an individual consumer in the United Kingdom.

The words written in these terms include emails as well as written communication through the post.

Termination of User Account

If the user does not want to continue using the websites of treatlocal.co.uk, they can request their account to be terminated by contacting the treatlocal.co.uk team at support@treatlocal.co.uk.

Suspension and deletion of User Account

The company makes a reasonable effort to keep the information accurate and up-to-date, however, the company does not give any assurances or guarantees for the accuracy of the content on the company websites.

The company reserves the right to change the content of the website at any time, without any prior notice.

This Website's content is supplied "as is," with no promises, conditions, or warranties as to its correctness.

Terms of Sale

You are offering to purchase a product on and subject to the following terms and conditions by placing an order. All orders are contingent on availability and pricing confirmation.

Results may take longer depending on availability and any delays caused by postal delays or force majeure for which we hold no responsibility. We intend to send your findings to you within 24-48 hours of the lab receiving your tests, however owing to the current high level of pressure on the testing system, this schedule cannot be guaranteed. In the case of antigen tests, once you have fully submitted your information with the required photos, we aim to process your results within 12-24 hours.

As a result, we will not be able to compensate for any travel delays. treatlocal.co.uk will not be held liable for any shipping or laboratory delays, nor will it be held liable for any damages suffered as a result of a test that is imprecise or inconclusive.

For a contract to be formed with https://www.treatlocal.co.uk/, you must be at least 18 years old and have a valid credit or debit card issued by a bank that is accepted by us.

If you place an order through our website and due to a technical issue, your payment does not go through, you will be required to make the payment before we can process and dispatch your order, if you do not make the payment, we reserve the right to cancel your order without further notice.

We will not be able to accept orders from outside the UK.

We will notify you in writing if we are unable to accept your order and will not charge you for the testing services. This could be due to a lack of current testing kits, unexpected constraints on our resources that we couldn't properly plan for, an error in the price or description of the services, or an inability to reach a delivery deadline you specified.

When we accept your order, we will assign it an order number and inform you of it. You can tell us your order number anytime you contact us about your order, that will enable us to deal with your request.

Our acceptance of your order will occur when we receive your payment and full details that we require at the time of purchase, at which point a contract between you and us will be formed.

We reserve the right to make changes to the services, products and our terms of sale without any prior notice as and when required.

Information required

We may require certain information from you in order to provide testing services to you; for example, when you request testing services, we are obligated by law to collect certain information from you. Whether you're buying general testing services (such as a general test to acquire a "Fit to Fly" certificate) or Test to Release services, the information we'll need will vary.

Information will be requested either when you place an order for testing services or when you register your testing kit on our website, or both. If you do not provide this information when we request it, or if you provide us with incomplete or inaccurate information, we may terminate the contract or impose a reasonable additional charge as compensation for any additional work that is required as a consequence. If you do not provide us with the information we need within a reasonable time after we ask for it, we will not be responsible for delivering the services late or not delivering any part of them. We may share your personal information with third parties in the ways and for the reasons described in our privacy statement.

We may have to stop providing our services (or parts of them) in order to:

update the services to reflect changes in applicable laws and regulations

and make adjustments to the services as you request or as we notify you.

resolving technical issues or making simple technical adjustments

Unless there is a problem that is severe or an emergency, we will notify you ahead of time that we will be stopping service.

If the services must be postponed for more than four days, we will alter the price so that you do not have to pay for the services while they are suspended. If we suspend the contract, or notify you we are planning to suspend it, for more than 4 days, you may contact us to stop the relationship, and we will reimburse any sums you have paid in advance for services not received.

If you do not complete the payment to us for the services when we expect you to, we may stop providing them until you pay us the outstanding sums.

In addition to stopping services, we may charge you interest on past-due payments.

Test Kits

It is critical that you carefully follow the directions included with your testing kit. These instructions will show you how to register your testing kit, collect a swab sample from yourself, package the swab sample, and send it to our testing facility. The swabs are quite sensitive, and the results are dependent on them. As a result, if you do not follow our directions, your results may be delayed or the testing services on your sample may not be available.

You must register your testing kit through the link that we provide you in the email, after receiving it, following the instructions included in the testing kit. This allows us to associate the testing kit with you and your order.

If you have purchased a rapid antigen test kit, it is your responsibility to ensure that you use it within the time frame window as per your respective travel destination requirement. You must register your details and upload clear images of the test kit with your Passport and an additional close-up image of the test kit. If you fail to provide the required information, we will not be issuing a certificate or results.

If we have photographs of testing kits or available certificates on our website, they are merely for illustration purposes, and the actual testing kit, packaging, or certificate you receive may look different.

Delivery Cost and Timing

Unless we specify otherwise on our website, the expenses of delivery of the testing kits to you and postage of the completed swab samples to our testing laboratories are included in the price you pay for the testing services.

The rapid antigen test kits are dispatched on the same day (Monday-Friday) given that you place and complete your order before the stated cut-off time for the same day dispatch. Orders placed before the cut-off time are sent by next day tracked delivery. If you place you order after the cut-off time on Friday or during the weekend, the order will be dispatched on the following Monday, subject to stock availability.

The testing kit that is delivered to you will not be yours. The testing kit will remain our property, which you are free to use (as long as you follow our instructions) in order to take advantage of our testing services.

If no one is available to accept delivery at your house and the testing kit cannot be mailed through your letterbox, we will leave you a note with instructions on how to reschedule delivery or pick up the testing kit from a local depot. It is your responsibility to either arrange a redelivery or pick-up your test kit from the local depot. We are unable to deal with any queries regarding missed deliveries.

Online booking for antigen tests

Online bookings for supervised antigen tests or collection are subject to the availability of the stock. The booking confirmation is for the time slot and not a confirmation of the stock availability. If the stock is unavailable, the customer may request for the appointment can be rescheduled or a full refund can be requested by the customer. By using our service, you agree that we will not be liable for any expenses, damages or costs incurred due to a delay or unavailability of the stock or service, directly or indirectly.

Product or Service Availability

We aim to keep the stock availability and service availability up-to-date, however, we cannot guarantee the availability of stock at the pharmacy and we are not liable for any expenses, damages or costs incurred by the customer as a result of stock or service unavailability, directly or indirectly. Customers should leave enough time to make alternative arrangements if such an event arises. By using our service, you agree that our total liability is limited to the full price of the product or service purchased from us.

Test result times

Our team aims to process all antigen tests to ensure that the results are provided within the estimated time frame but we do not offer any warranties or guarantees to provide the results in the estimated time frame. By using our service you agree that we are not liable for any losses, damages or expenses incurred due to delays in test results for any reason. You agree that the submission of incomplete, unclear or incorrect information or test results may cause delays in the processing of your test results and we will not be liable for any expenses, losses or damages incurred by the customer, directly or indirectly.

Ending Your Contract

You have the option to terminate your contract with us. Your rights when you cancel the contract will be determined by the services you purchased, if any portion of the services is defective, and our performance.

You may have a legal right to terminate the contract if the testing kit is defective or misdescribed, or if the services are defective in any manner (or to request a replacement kit or a re-testing service, or to receive a partial or whole refund).

You must pay us for the services supplied up until the moment you tell us you have changed your mind if you cancel after we have started the services.

Termination of contract

If you break the contract, we may be forced to terminate it. We may terminate the contract at any time by notifying you in writing if:

-You do not pay us when it is due, and you do not pay us within 7 days of us notifying you that payment is due.

-You do not allow us to send or collect the testing kit from you or you do not grant us access to your premises to provide the services within a reasonable time frame.

We will reimburse any money you have paid in advance for services we have not supplied if we stop the contract in the scenarios listed above, but we may deduct or charge you a fair sum as compensation for the net costs

We may stop providing services. If we do we may send you an email to inform you that we will no longer be offering the services. We will notify you at least 7 days before we stop providing the services so that you can finish your swab samples and send them to our testing facilities in time.

Liability

We are not responsible for any financial losses. We exclusively provide testing services for residential and private usage (this includes the testing kit and any certificates). We will not be liable to you for any loss of profit, loss of business, business interruption, or loss of business opportunity if you utilise the testing services for any commercial, business, or re-sale purpose. We will not be liable if you don't use the testing kit before it's due to expire.

We shall not be liable for any losses you may incur as a result of you providing incomplete, erroneous, or inaccurate information that we request when you order testing services. This also includes if you did not follow the directions that came with the testing kit. Such as if you fail to register the testing kit (including incomplete, incorrect or inaccurate information being provided), swab a sample of your own, package properly and/or send the sample to the laboratory within the relevant timeframe.

Covid-19 testing, like any scientific and technical processes, may not always yield decisive (correct) test results. This is unavoidable and no one's responsibility. Inconclusive results can also be caused by a number of factors. If your test results are inconclusive, we will provide you with a free replacement testing kit, but we will not be liable for any losses you may incur as a result.

We shall not be responsible for any losses you incur in excess of the cost of the testing services. We will not be liable to you for any losses you incur in excess of the price you paid for the testing services if those losses are caused by us failing to comply with these terms due to the actions of a third party or other factors beyond our control, such as the failure of a third party to comply with these terms. This includes but is not limited to:

- If Royal Mail or another relevant carrier fails to deliver your sample to the testing laboratory within a reasonable time after you have sent it off in line with our instructions, you will experience a delay in receiving your results.

- If you don't get your findings right away because of a delay or malfunction at the testing lab that is beyond our control

- If Royal Mail or another appropriate carrier loses your completed swab sample in transit after you have sent it to the lab as instructed.

- If you don't get your findings right away because of a delay or malfunction at the testing lab that is beyond our control. Including if the laboratory experiences a problem or other delay that causes the testing laboratory to lose your sample or to fail to test it within the required period after receiving it.

Due to the dynamic nature of the pandemic and travel rules, we cannot confirm that our tests will be accepted by a specific airline or country. It is your responsibility to check the requirements of your airline/travel destination(s) and make sure that the test you are purchasing is suitable. If your test results/certificate is rejected by an airline/country/venue, we will not be liable to provide any refunds or damages that you might incur directly or indirectly.

Choice of Law

This agreement is governed by English Law, and any disputes arising will be only subject to the jurisdiction of English courts.
